I. Mediation and Arbitration
BDR performs mediations and arbitrations for cases and claims in the following areas:
- Personal Injury/Wrongful Death
- Insurance Coverage/Bad Faith
- Product Liability
- Professional Malpractice
- Premises Liability
- Commercial/Business
- Real Estate
- Intellectual Property
- Employment
The only cases and claims not handled by BDR are domestic, construction defect and foreclosure matters.
Mr. Bongiovi's fee for mediation and arbitration is $400 per hour. There are no administrative fees. For proceedings held outside Las Vegas, Nevada, travel time is billed at $175 per hour and travel expenses and lodging are billed at cost. There are no lodging expenses for matters handled in the five boroughs of New York, NY.
II. Mediator's Case Analysis
In response to client demand, BDR also offers a case analysis service in those same practice areas mentioned above.
To further the resolution of the matter submitted, a case analysis provides the requesting party with an objective evaluation of the strengths and weaknesses of the case along with a detailed discussion of strategy and further handling to resolve the matter. To this end, clients provide BDR with the case materials upon which they want the matter analyzed. The materials are then reviewed at an hourly rate of $400. Once the review is completed (typcially within two weeks of submission), a bill is submitted to the party. Once the bill is paid in full, a videoconference is arranged with the relevant attendees to discuss all aspects of the case with an eye toward settlement.
It is preferred that case materials be submitted via email or digitally via disc though traditional hard copies can be submitted by prior arrangement. Parties call BDR before submitting a matter so that a conflict check can be performed and delivery and payment arrangements can be made in advance.
Any matter submitted for case analysis is disqualified for later mediation or arbitration with BDR, and no guarantees are made regarding case outcomes.
Mr. Bongiovi's efforts are offered in furtherance of settlement under NRS 48.109 and are therefore confidential. All material submitted to or coming from BDR, and all communications between Mr. Bongiovi and the party seeking the analysis are considered confidential. All material submitted to BDR is shredded at the end of the analysis process and Mr. Bongiovi's notes, if any, are destroyed.
